Pelvic Mesh Device Case Remanded to Missouri State Court

KANSAS CITY, Mo. - A Missouri federal judge has remanded to state court a pelvic mesh device injury case, ruling that the nondiverse healthcare defendants were not misjoined because they can be jointly, severally, or alternatively liable with the device manufacturers for the plaintiff's alleged damages. Hagensicker v. Boston Scientific Corp., No. 12-5018 (W.D. Mo.).

Judge Richard E. Dorr of the U.S. District Court for the Western District of Missouri noted that the plaintiff accused her doctors of negligently implanting the devices and that the devices were defective. Therefore each defendant potentially contributed to the alleged injuries, the judge reasoned.
