Ky. Federal Judge Finds for Eli Lilly in 21 Propoxyphene Cases

COVINGTON, Ky. - A Kentucky federal judge has granted Eli Lilly judgment on the pleadings in 21 propoxyphene injury cases, ruling that plaintiffs failed to establish that they ingested drugs manufactured by Lilly. In re Darvocet, Darvon and Propoxyphene Products Liability Litigation, MDL No. 2226 (E.D. Ky.).
On March 7, Judge Danny C. Reeves of the U.S. District Court for the Eastern District of Kentucky ruled that the complaints did not sufficiently plead that plaintiffs ingested Darvocet, Darvon or propoxyphene manufactured by Lilly before 2002, when the drug maker sold its new drug application for propoxyphene products.
