S.C. Federal Judge Dismisses Hormone Replacement Suit for Lack of Causation

BEAUFORT, S.C. - A South Carolina federal judge has dismissed a hormone replacement therapy action against Wyeth Inc., ruling that without medical and pharmaceutical records, the plaintiff could not establish proximate causation. Sauls v. Wyeth Pharmaceuticals Inc., No. 9:04-22297 (D. S.C.).
On March 7, Senior District Judge Henry M. Herlong Jr. ruled that in the absence of these records and without the testimony of the now deceased prescribing physician, the plaintiff cannot show that a different warning would have altered the doctor's prescription decision.
