ATLANTA – A Georgia federal judge has denied Wright Medical Technology Inc. summary judgment on a design defect claim in a suit involving its ProFemur hip implant, ruling that an issue of fact exists as to whether the manufacturer unreasonably refused to use an alternative safer design. Mims v. Wright Medical Technology Inc., No. 11-213 (N.D. Ga.).
On May 11, Judge Thomas W. Thrash Jr. of the U.S. District Court for the Northern District of Georgia also denied Wright Medical summary judgment on the failure-to-warn claim, finding a question as to whether the device maker adequately warned the plaintiff’s surgeon …
