NexGen Plaintiffs Object to Zimmer’s Proposal to Retain Treating Physicians as Experts

CHICAGO — Plaintiffs in the Zimmer NexGen Knee Implant MDL oppose a proposal by defendants to contact and retain treating surgeons as experts in cases not involving their own patients. In re: Zimmer NexGen Knee Implant Products Liability Litigation, MDL No. 2272 (N.D. Ill.).
Zimmer Inc. formally requested an order allowing ex parte communications with implant surgeons for that purpose June 4, saying that given the sheer number of plaintiffs in the multidistrict proceeding and the limited number of surgeons, the need for such communications are obvious.
