LOS ANGELES - California plaintiffs pursuing claims over allegedly defective DePuy Pinnacle hip implants are opposing transfer to an MDL in Texas and are simultaneously pursuing efforts to persuade a California federal judge to remand their case to state court. Colburn, et al. v. DePuy Orthopaedics Inc., et al., No. 2:12-cv-00962 (C.D. Calif.).
Joseph Colburn and eight co-plaintiffs filed a Notice of Opposition to the JPML's Conditional Transfer Order No. 54 in MDL No. 2244 Feb. 22, and have 14 days in which to submit a supporting brief (In re: DePuy Orthopaedics Pinnacle Hip Implant Product Liabilities Litigation).
