Woman's Suit Against Accutane Makers is Timely, N.J. Supreme Court Affirms

TRENTON, N.J. - A suit brought against the makers of Accutane by a woman who claimed the drug caused her to develop ulcerative colitis is not time-barred, the New Jersey Supreme Court majority has affirmed, ruling that if the warnings are presumed sufficient to place an adult consumer on reasonable notice of a drug's risks, they bear on what the consumer reasonably should have known about potential side effects. Kendall v. Hoffman-La Roche Inc., No. 066802 (N.J. Sup. Ct.).
