N.J. NexGen Plaintiffs, Zimmer Defendants, Swap 'Forum Shopping' Accusations

TRENTON, N.J. - Counsel for six of the eight plaintiffs cited in Zimmer Holdings Inc.'s application to coordinate the state's NexGen Flex knee implant cases have submitted written objections, saying the move is unnecessary and an attempt at forum shopping. Re Application for Centralized Management for Cases Involving Certain NexGen Flex Products (N.J. Sup. Ct.).

Plaintiffs' counsel Ellen Relkin of Weitz & Luxenberg also disputed Zimmer's prediction of the number of case filings, saying it is doubtful the number of filings against Zimmer and its in-state distributor and surgeons will meet numerosity requirements for centralization.
