Judge Allows Pain Pump Injury Case to Proceed Against Stryker

KNOXVILLE, Tenn. - Negligence and strict liability claims brought against Stryker Corp. in a pain pump action are not time-barred because the plaintiff could not have reasonably discovered earlier the connection between the device and his alleged injury, a Tennessee federal judge has ruled. Cates v. Stryker Corp., No. 3:10-546 (E.D. Tenn.).

On Jan. 27, Judge Thomas W. Phillips of the U.S. District Court for the Eastern District of Kentucky further ruled that the plaintiff pleaded his fraud claims with the requisite particularity.
