URBANA, Ill. - Claims that a hip prosthesis manufactured by Wright Medical Technology was unreasonably dangerous have been dismissed by a federal judge, who found no basis for the claims under either a risk-benefit analysis or an ordinary consumer expectations test. Cappellano v. Wright Medical Group Inc., et al., No. 08-cv-2265 (C.D. Ill.).
Chief Judge Michael P. McCuskey of the U.S. District Court for the Central District of Illinois granted the Wright Medical defendants' combined motion to dismiss and for summary judgment on Jan. 23, vacating scheduling orders for a trial scheduled to begin March 5.
