Judicial Panel Rejects Opposition and Finalizes Transfer of 27 Cases to ASR MDL

WASHINGTON, D.C. - The Judicial Panel on Multidistrict Litigation has finalized the transfer of 27 DePuy ASR cases to the multidistrict proceedings in Ohio, rejecting opposition filings that the panel said were based mostly on pending motions for remand. In re: DePuy Orthopaedics, Inc., ASR Hip Implant Products Liability Litigation, 10-md-2197 (N.D. Ohio).

The panel said all 27 of the transferred cases raise questions of fact common to the MDL and that plaintiffs can still pursue remand after transfer to the consolidated proceedings pending before Judge David A. Katz in the U.S. District Court for the Northern District of Ohio.
