Ga. Federal Judge Says Vaginal Mesh Suit is Untimely, Inadequately Pleaded

ATLANTA - A Georgia federal judge has dismissed a vaginal mesh suit brought against Boston Scientific Corp., ruling that the plaintiff failed to establish a question of fact as to whether the discovery rule saves her case, which was filed after expiration of the statute of limitations. Goodson v. Boston Scientific Corp., No. 1:11-3023 (N.D. Ga.).
On Dec. 29, Judge Thomas W. Thrash Jr. of the U.S. District Court for the Northern District of Georgia further ruled that the plaintiff failed to plead her negligence, strict liability, breach of warranty and fraud claims with the requisite particularity.
