PHILADELPHIA - A Pennsylvania state judge has refused to dismiss state law failure-to-warn claims brought against the makers of generic Reglan, ruling that the drug makers failed to show that PLIVA v. Mensing would foreclose all of the claims against them. In re Reglan/Metoclopramide Litigation, No. 11090904 (Pa. Comm. Pls. Ct., Phila. Cty.).
On Nov. 18, Judge Sandra Mazer Moss of the Philadelphia Court of Common Pleas ruled that any global decision on plaintiffs' allegations of Mensing "carve-outs" is premature and must undergo a state-by-state analysis.
