DePuy ASR Plaintiff Petitions 6th Circuit for Relief from MDL Transfer Order

CINCINNATI - A Florida plaintiff whose case was transferred to the coordinated DePuy ASR proceedings in Ohio while her motion for remand to state court was pending has petitioned the 6th Circuit to address the jurisdictional issues and vacate the Judicial Panel on Multidistrict Litigation's transfer order. McConnell v. Mark Debiase Inc., et al., No. 11-4265 (6th Cir.).

Shannon McConnell filed the Petition for Writ of Mandamus on Nov. 16, saying the remedy of mandamus is appropriate because "federal subject matter jurisdiction has clearly been lacking in this case since its inception."
