CHICAGO - Plaintiffs in the Zimmer NexGen Knee Implant MDL have filed an objection to language in defendants' proposed medical authorization form referring to a plaintiff's "psychological condition," saying it mistakenly suggests that plaintiffs have waived any applicable mental health privilege. In re: Zimmer NexGen Knee Implant Products Liability Litigation, MDL No. 2272 [Master Docket No. 1:11-cv-05468] (N.D. Ill.).
Plaintiffs submitted their opposition on Nov. 9, asking the MDL court to strike the term before approving the language in the proposed authorization.
