LAS VEGAS - A Nevada federal judge has denied a motion to certify a class of patients who allege they were exposed to blood-borne diseases after receiving a general anesthetic during endoscopies because the drug makers failed to adequately warn against multi-dosing. Rader v. Teva Parenteral Medicines Inc., et al., No. 10-818 (D. Nev.).
On Oct. 5, Judge James C. Mahan of the U.S. District Court for the District of Nevada ruled that the individual issues predominate over issues common to the proposed class.
