NEW YORK - A New York federal jury has found in favor of Merck on claims that its osteoporosis drug Fosomax caused a Florida woman to develop osteonecrosis of the jaw. Secrest v. Merck & Co. Inc., No. 06-6292 (S.D. N.Y.).
A jury sitting in the U.S. District Court for the Southern District of New York handed down the Oct. 3 verdict. Judge John F. Keenan presided over the trial.
Linda Secrest sued Merck in the U.S. District Court for the Middle District of Florida, alleging that she used Fosamax from 2000 until her April 2005 diagnosis.
