Trasylol Suit is Time-Barred, 11th Circuit Affirms

ATLANTA - A Trasylol injury suit is barred by California's two-year statute of limitations because the plaintiff should have suspected that the drug caused his kidney damage by 2005 when he brought a related medical malpractice suit against his doctors, a federal appellate court has affirmed. Bechara, et ux. v. Bayer Corp., No. 10-13197 (11th Cir.).

On Sept. 9, the 11th Circuit U.S. Court of Appeals explained that a "reasonable investigation" conducted by the plaintiff would have showed a connection between the claimed injury and Trasylol.
