Judge Dismisses Transvaginal Mesh Suit But Grants Plaintiff Leave to Amend

SACRAMENTO, Calif. - A California federal judge has dismissed a transvaginal mesh injury case, ruling that the claims are time-barred because the complaint suggests that the plaintiff should have been aware that her device was defective by July 2007. Coleman v. Boston Scientific Corp., No. 10-1968 (E.D. Calif.).

However, in the Aug. 29 order, Judge Oliver W. Wagner of the U.S. District Court for the Eastern District of California allowed the plaintiff to amend her complaint to allege facts sufficient to suggest that her claims are not time-barred.
