Jury Finds for Breg in First Pain Pump Trial

BILLINGS, Mont. - A Montana federal jury has returned a defense verdict in the first pain pump injury case to go to trial, finding that while the device was "defective and unreasonably dangerous," it conformed with the state of the art at the time it was sold. Davis v. Breg Inc., No. 1:09-00144 (D. Mont.).

The U.S. District Court for the District of Montana jury issued the Aug. 16 verdict in favor of Breg Inc. after a six-day trial and one day of deliberations. Magistrate Judge Keith Strong oversaw the trial.
