Biomet Subsidiary Cites Biomaterials Act in Moving for Dismissal from N.J. Suit

NEWARK, N.J. — A Biomet Inc. manufacturing subsidiary accused of negligent design and manufacturing has moved for dismissal from a hip implant suit, asserting immunity as a component parts maker under the federal Biomaterials Access Assurance Act. Hanson v. Biomet, Inc., et al., 2:12-cv-03359-FSH-PS (D. N.J.).

Defendants Biomet Fair Lawn LLC (also sued as Biomet Fair Lawn L.P.) argues in its June 11 motion that it is a component supplier, not a manufacturer of the M2a-Magnum metal-on-metal hip implant at issue and, thus, protected under the BAAA (21 U.S.C. § 1605[a]).
