DENVER - A federal appeals court has reversed a grant of summary judgment to Eli Lilly & Co. in a Prozac murder-suicide case, ruling that the trial court should have allowed the plaintiff to present a new expert witness. Rimbert v. Eli Lilly and Co., No. 06-0874 (10th Cir.).
On Aug. 3, the 10th Circuit U.S. Court of Appeals ruled that the drug maker would not have been prejudiced had the plaintiff been granted an additional 60 days to name a new expert after the trial court excluded the testimony of his original expert witness.
