WASHINGTON, D.C. - Plaintiff Fred Stone has replied to Zimmer Inc.'s brief opposing the creation of a NexGen knee replacement MDL, saying that Zimmer's assertion that there are too many dissimilarities in materials and procedures among plaintiffs' claims is misleading and contrary to the defendant's own marketing and surgical technique brochures. In re: Zimmer NexGen Knee Products Liability Litigation, MDL Docket No. 2272 (JPML).

Stone, who has asked the Judicial Panel on Multidistrict Litigation to consider consolidating the actions in the U.S. District Court for the Northern District of Illinois, submitted his reply brief to the panel on July 5.
