Trasylol Claims are Time-Barred, Federal Judge Rules

MIAMI - A Florida federal judge has granted Bayer Corp. summary judgment on Trasylol injury claims, ruling that they are time-barred because the plaintiff was aware of his post-surgery renal injuries in 2004 - four years before filing suit. Putnam v. Bayer Corp., No. 08-81432 (S.D. Fla.).

On May 27, Judge Donald M. Middlebrooks of the U.S. District Court for the District of Miami ruled that the three-year limitations period began to run when the injury, not the cause of the injury, was discovered or should have been discovered.
