PHILADELPHIA - A Pennsylvania federal judge has granted a medical device maker summary judgment on claims that its syringes were defective and caused a woman to contract an infection during a breast expansion procedure. Pusey v. Becton Dickinson & Co., No. 10-3344 (E.D. Pa.).
On June 7, Judge Stewart Dalzell of the U.S. District Court for the Eastern District of Pennsylvania ruled that the plaintiffs failed to prove that the syringes were defective because the sole basis for their claims, evidence of a product recall, was inadmissible under Federal Rule of Evidence 407.
