Pain Patch Claims Satisfy 'Same Transaction or Occurrence' Requirement, Judge Rules

TULSA, Okla. - An Oklahoma federal judge refused to dismiss the claims of a plaintiff who was joined in a fentanyl patch wrongful death case, ruling that the claims satisfy the "same transaction or occurrence" requirement because they arise from a sufficiently similar set of factual circumstances. Jacobs v. Watson Pharmaceuticals Inc., No. 10-120 (N.D. Okla.).

On June 7, Judge Terence Kern of the U.S. District Court for the Northern District of Oklahoma further found that the claims satisfy the logical relationship test because they all arise under Oklahoma law and are reasonably related in time, location and type.
