SACRAMENTO, Calif. -A federal judge has refused to stay a Prempro breast cancer case pending a Daubert hearing in the multidistrict litigation proceedings, ruling that a factual dispute exists as to the result of the plaintiff's tissue tests and this issue "must be answered in the affirmative" in order for a stay to be issued. Indio v. Wyeth Inc., et al., No. 10-295 (E.D. Calif.).
