RICHMOND, Va. - A federal appeals court has upheld a grant of summary judgment to the maker and distributor of Remicade in a wrongful death action, ruling that the plaintiffs failed to prove that the drug was defective. Mack v. AmerisourceBergen Drug Corp., et al., No. 10-1019 (4th Cir.).

On April 26, the 4th Circuit U.S. Court of Appeals affirmed that a reasonable juror could not determine that the drug was "unreasonably dangerous."
