N.J. Appellate Court Upholds Defense Verdict in Aredia/Zometa Case

TRENTON, N.J. - A New Jersey appellate court upheld a verdict in favor of Novartis Pharmaceuticals Corp. in an Aredia/Zometa injury case, ruling that the trial court’s pre-trial grant of partial summary judgment to the drug maker on the failure-to-warn issue was not reversible error. Bessemer v. Novartis Pharmaceuticals Corp., No. A-2069-10T1 (N.J. Super. Ct., App. Div.).

On June 13, the New Jersey Superior Court, Appellate Division, further noted that after the trial court issued its pre-trial orders, it reaffirmed that a drug maker's compliance with Food and Drug Administration requirements “presents a rebuttable presumption of adequacy of warnings.”
