Judge Allows Fraud Claims to Proceed Against Reglan Manufacturers

MONTGOMERY, Ala. - An Alabama federal judge has refused to dismiss claims accusing Reglan manufacturers of breaching their duty to disclose to prescribing physicians the risks associated with the long-term use of generic metoclopramide. Weeks v. Wyeth, et al., No. 10-602 (M.D. Ala.).

On March 31, Chief Judge Mark E. Fuller of the U.S. District Court for the Middle District of Alabama ruled that the manufacturers failed to establish that a relationship between themselves and the plaintiff is required when the claims are based on fraud perpetrated against the prescribing physician.
