PHILADELPHIA - A Pennsylvania federal judge has remanded to state court an Accutane injury action, ruling that the sole Philadelphia-based defendant, a drug information publisher, was not fraudulently joined to destroy diversity jurisdiction. Slater v. Hoffman-La Roche Inc., et al., No. 10-6956 (E.D. Pa.).

Judge Jan DuBois of the U.S. District Court for the Eastern District of Pennsylvania ruled March 25 that a court could find that the publisher assumed a duty to the plaintiff based on its voluntary provision of information and warnings about Accutane.
