MINNEAPOLIS - A Minnesota federal judge has adopted a magistrate's recommendation that a plaintiff has sufficiently pleaded fraudulent concealment in a pain pump injury action, therefore the statute of limitations was tolled. Cantonis v. Stryker Corp., et al., No. 09-3509 (D. Minn.).
On March 21, Judge John R. Tunheim of the U.S. District Court for the District of Minnesota also agreed with Magistrate Judge Jeffrey J. Keyes that it is not clear on the face of the pleadings whether Minnesota or Texas law applies, therefore it would be premature to conduct a choice of law analysis.
