MIAMI - A Florida federal judge has dismissed without prejudice six Trasylol injury/wrongful death cases brought against Bayer, ruling that the plaintiffs failed to timely effect service before the cases were transferred to the Trasylol Multidistrict Litigation. In re Trasylol Products Liability Litigation, Nos. 09-cv-80235; 09-cv-80329; 09-cv-80230; 09-cv-80239; 09-cv-80245 and 09-cv-80309, MDL No. 1928 (S.D. Fla.).
On March 8, Judge Donald M. Middlebrooks of the U.S. District Court for the Southern District of Florida refused to extend the time for service, ruling that plaintiffs failed to show good cause for the failure.
