ABERDEEN, Miss. - A Mississippi federal judge has set aside a default judgment entered against Wyeth in a Prempro breast cancer case, ruling that the drug maker's failure to timely file an answer was "not willful" and that the plaintiff was not prejudiced by the delay. Horner v. Wyeth, No. 10-147 (N.D. Miss.).
On Feb. 25, Judge Sharion Aycock of the U.S. District Court for the Northern District of Mississippi accepted Wyeth's explanation that the delay was caused by problems with the pilot Case Management/Electronic Case Filing system.
