LITTLE ROCK, Ark. - An Arkansas Supreme Court majority has affirmed that a pharmacy has no duty to warn a customer about a potentially dangerous mix of prescription drugs or to inquire about doctors who write such prescriptions. Kowalski v. Rose Drugs of Dardanelle Inc., No. 10-459 (Ark. Sup.).
The majority, led by Associate Justice Donald L. Corbin, ruled that the pharmacy defendant in this wrongful death action had "no duty other than to fill the prescription as prescribed and properly label it."
