SACRAMENTO, Calif. - A state prisoner who alleges that his diabetes was caused by Zyprexa failed to sufficiently plead a state law products liability claim against Eli Lilly Co., a California federal judge has ruled. Singleton v. Eli Lilly Co., No. 10-2019 (E.D. Calif.).
On Jan. 28, Magistrate Judge Sheila K. Oberto of the U.S. District Court for the Eastern District of California granted the plaintiff leave to amend his complaint to cure its multiple deficiencies.
