BIRMINGHAM, Ala. - An Alabama federal judge has granted Wyeth Inc. and Schwarz Pharma Inc. summary judgment on metoclopramide injury claims on the basis that they did not manufacture the generic drug dispensed to the plaintiffs. Simpson v. Wyeth Inc., No. 10-1771 (N.D. Ala.).
On Jan. 4, Judge William M. Acker Jr. of the U.S. District Court for the Northern District of Alabama adopted Magistrate Judge Harwell G. Davis III's finding that the name brand manufacturers had no duty to warn doctors of the generic drug's risks.
