CINCINNATI - An Ohio federal judge has granted Breg Inc. summary judgment in a pain pump injury suit, ruling that the manufacturer could not have known that the implantation of its device in shoulder joints could cause cartilage damage. Krumpelbeck v. Breg Inc., No. 09-91 (S.D. Ohio).
On Dec. 27, Judge Timothy S. Black of the U.S. District Court for the Southern District of Ohio concluded that at the time the device was implanted, "the now-purported association between chondrolysis and anesthetic infusion in the shoulder joint was unknown to Defendant, and, indeed, to the entire medical scientific community."
