Actavis Denied Summary Judgment in Metoclopramide Case

TAMPA, Fla. - A Florida federal judge has denied Actavis Inc. summary judgment in a metoclopramide injury suit, ruling that a question of fact exists as to whether the prescribing doctor would have informed the plaintiff of the risk of tardive dyskinesia had the drug maker provided a better warning. Levine v. Wyeth, No. 09-854-T-33 (M.D. Fla.).

On Dec. 10, Judge Virginia M. Hernandez Covington of the U.S. District Court for the Middle District of Florida further ruled that an issue of fact exists as to whether the plaintiff would have heeded such a warning.
