Jury Finds for Wyeth on Failure-to-Warn Claim in Prempro Case

ALEXANDRIA, Va. - A Virginia federal jury has found in favor of Wyeth in a Prempro breast cancer case, finding that the drug maker properly warned the plaintiff's doctors of the drug's risks. Torkie-Tork v. Wyeth, No. 1:04-945 (E.D. Va.).
On Dec. 3, the U.S. District Court for the Eastern District of Virginia jury determined that Georgia Torkie-Tork failed to prove that Wyeth downplayed the risk of breast cancer posed by the hormone therapy drug.
Torkie-Tork, now 65, was prescribed Prempro in 1996 for treatment of severe menopausal symptoms. Plaintiff continued the treatment until June 2002, when an abnormality …
