Jury Finds for Merck in Bellwether Fosamax Case

NEW YORK - A New York federal jury has returned a verdict in favor of Merck & Co. Inc. in a bellwether Fosamax injury case, finding that the plaintiff's osteonecrosis of the jaw was not proximately caused by her use of the drug. Graves v. Merck & Co. Inc., No. 1:06-05513 (S.D. N.Y.).
The Nov. 19 verdict was returned in the U.S. District Court for the Southern District of New York. Merck has so far won three of the first four bellwether cases in the Fosamax multidistrict litigation.
