Wyeth Granted Summary Judgment In Prempro Injury Case

ALEXANDRIA, Va. - A federal judge has granted Wyeth summary judgment on a fraudulent concealment claim brought in a Prempro breast cancer case, ruling that the drug maker's delay in implementing FDA-approved changes to its label was not intentional. Torkie-Tork v. Wyeth, No. 1:04cv945 (E.D. Va.).
On Nov. 4, Judge T.S. Ellis III of the U.S. District Court for the Eastern District of Virginia ruled that the delay in implementing the changes was caused by the Food and Drug Administration, not by Wyeth.
Georgia Torkie-Tork was prescribed Prempro in 1996 by Dr. Joel Schulman for treatment of severe menopausal symptoms. …
