Mentor Denied Summary Judgment in Transobturator Sling Case

ATHENS, Ga. - A Georgia federal judge has denied Mentor Corp. summary judgment in a product liability suit concerning its ObTape Transobturator Sling product, finding issues of fact as to whether the device was manufactured in conformance with Mentor's specifications. In re Mentor Corp. ObTape Transobturator Sling Products Liability Litigation, Nos. 08-MD-2004 and 08-05000 (M.D. Ga.).
On Oct. 29, Judge Clay D. Land of the U.S. District Court for the Middle District of Georgia also found issues of fact as to whether Mentor's warnings were adequate and whether the ObTape's benefits outweigh its risks.
