PHILADELPHIA - A class member under the Diet Drug Nationwide Class Action Settlement Agreement has failed to demonstrate a reasonable medical basis to support his claim for $704,750 in Matrix A-1, Level V benefits, a Pennsylvania federal judge has ruled. In re Diet Drugs Products Liability Litigation, MDL No. 1203, Civ. No. 99-20593 (E.D. Pa.).
On Sept. 28, Chief Judge Harvey Bartle III of the U.S. District Court for the Eastern District of Pennsylvania ruled that Lonnie D. Gleave did not suffer from sustained ventricular tachycardia as required by the settlement agreement for Level V benefits.
