PIERRE, S.D. - A federal judge has denied Eli Lilly & Co. summary judgment on deceit and punitive damages claims brought in a Cymbalta suicide case, ruling that issues of fact exist as to whether the drug maker chose not to release information chose not to disseminate information linking Cymbalta to pediatric and adolescent suicide. Schlif, et ux., v. Eli Lilly & Co., No. 07-4015 (D. S.D.).
On Sept. 30, Judge Lawrence Piersol did, however, grant the drug maker summary judgment on the claims of negligent failure to test, negligent overpromotion and negligent infliction of emotional distress.
