COLUMBIA, S.C. - A federal judge has dismissed Reglan injury claims brought against Wyeth Inc. and Schwarz Pharma Inc. on the basis that they did not manufacture the Reglan or metoclopramide ingested by the plaintiff. Fisher v. Wyeth Inc., et al., No. 09-00252 (D. S.C.).
Judge Terry L. Wooten of the U.S. District Court for the District of South Carolina relied upon 4th Circuit and South Carolina case law, which states that a manufacturer of a brand name prescription drug may not be held liable for injuries arising from the use of another manufacturer's generic equivalent.
