NEW YORK - A New York appellate court has ruled that out-of-state Oxycontin cases should be litigated in outside courts because New York is not a convenient forum for nonresident plaintiffs' complaints. Miller, et al. v. Purdue Pharma Co., No. 2009-02849 (N.Y. App. Div., 1st Dept.).
In a Sept. 21 order, the New York Appellate Division, 1st Department, noted, among other things, that there is no significant dispute that the drug at issue was not manufactured in New York and that the drug was not ingested in that state.
