LITTLE ROCK, Ark. - An Arkansas federal judge has dismissed product liability claims brought against Wyeth Inc., Pfizer Inc., Alaven Pharmaceutical and Schwarz Pharma Inc. on the basis that they did not manufacture the generic metoclopramide ingested by the plaintiff. Fullington v. Pfizer Inc., et al., No. 4:10-236 (E.D. Ark.).
Arkansas case law states that a manufacturer of a brand name prescription drug may not be held liable for injuries arising from the use of another manufacturer's generic equivalent, ruled Judge J. Leon Holmes of the U.S. District Court for the Western District of Arkansas on Sept. 17.
