Judge Rejects Negligence Claims in Generic Sulindac Case

CONCORD, N.H. - A New Hampshire federal judge has dismissed a negligence claim in a suit claiming that generic Sulindac caused a woman to contract toxic epidermal necrolysis, ruling that she failed to prove that Mutual Pharmaceutical Company Inc.'s negligent conduct caused her injuries. Bartlett v. Mutual Pharmaceutical Company Inc., No. CV-08-358-JL (D. N.H.).

In the Sept. 14 order, Judge Joseph N. Laplante of the U.S. District Court for the District of New Hampshire further ruled that the plaintiff, Karen Bartlett, is not entitled to enhanced compensatory damages due to lack of causation.
