Maine Law Applies to Punitive Damages Claims in Children's Motrin Case

PHILADELPHIA - Maine, rather than Pennsylvania, law will apply to punitive damages claims brought against the makers of Children's Motrin in a personal injury case because Maine has the greatest interest in having its law applied, a federal judge has ruled. Wolfe v. McNeil-PPC Inc., et al., No. 07-348 (E.D. Pa.).
Because the drug was prescribed and taken in Maine, that state is most interested in the outcome of this litigation, Judge Jan E. DuBois of the U.S. District Court for the Eastern District of Pennsylvania explained.
